Judge Throws Out Sentence in Teen Sex Case

A teenager getting a 10 year mandatory sentence for sucking? That really sucks!
The case began three years ago when Mr. Wilson was arrested for having consensual oral sex with a 15-year-old girl at a New Year’s Eve party in 2003. Under Georgia law, that offense qualified as aggravated child molestation, a felony charge largely intended for use against adult sexual predators, not teenagers like Mr. Wilson, who was 17 at the time of the incident. He had no prior criminal record and was an honors student and star athlete.

Critics pointed out that if Mr. Wilson had engaged in full sexual intercourse with the girl instead of oral sex, under Georgia law he could have been charged only with a misdemeanor, because of an exemption written into the molestation law specifically to cover contact between minors. But because that exemption did not mention oral sex, when Mr. Wilson was convicted, he received a mandatory sentence of ten years in prison without possibility of parole.
Yet another victory for 'tough on crime' mandatory sentencing. So remember kids; don't suck, fuck! It's the way to get off on a misdemeanor.

On the surface this is crazy. However the last line of the article says:

“Six young men basically gang-raped a 17-year-old and had repeated sex acts with a 15-year-old,” Mr. McDade said in a television interview last year. “‘There’s no member of the legislature that I think would condone that behavior.’”

Which is why they wouldn't extend the changing of the law retroactively to him. It sounds like they used an obsolete law that was still on the books to nail a rapist.

I'm glad they corrected the law, but hey, if it kept a rapist off the streets for the last 2 years I ain't losing any sleep. If however it kept a teen who got lucky at a party with another consenting teen it was barbaric.

Remember that it says 'consensual oral sex' earlier in the article. It appears a law maker may have intentionally overstated the circumstances to make an emotional plea in an attempt to justify his position. That position apparently does not include standing in front of someone with his dick in their mouth.
